Stornierungen müssen bis spätestens um 18:00 Uhr am entsprechenden Tag schriftlich erfolgen!

(*während Messen oder Kontingentraten gilt hier die Regelung einer kostenfreien Stornierung eines einzelnen Zimmers bis 7 Tage vor der Anreise. Messen- und Kontintgentzeiträume sind in den Bestätigungen des Hotels separat gekennzeichnet).

Übernachtungen mit Frühstück, die außerhalb der genannten Fristen schriftlich an das Hotel erfolgen, werden mit einer Ausfallgebühr von 80% der vereinbarten Rate pro Zimmer/Nacht berechnet. Bei Nichterscheinen werden ebenfalls  Stornierungsgebühr in Höhe von 80% der vereinbarten Rate pro Zimmer/Nacht berechnet.

Übernachtungen ohne Frühstück, die außerhalb der genannten Fristen
schriftlich an das Hotel erfolgen, werden mit einer Ausfallgebühr von 90% der vereinbarten Rate pro Zimmer/Nacht berechnet. Bei
Nichterscheinen werden ebenfalls  Stornierungsgebühr in Höhe von 90% der
vereinbarten Rate pro Zimmer/Nacht berechnet.

Kontingentraten

ALLGEMEINE GESCHÄFTSBEDINGUNGEN

I. Geltungsbereich

1. Diese Geschäftsbedingungen gelten für Verträge zwischen dem Hotel Der Blaue Reiter in Karlsruhe und dem Kunden über die mietweise Überlassung von Konferenz-, Bankett- und Veranstaltungsräumen zur Durchführung von Veranstaltungen wie Banketten, Seminaren, Tagungen und ähnlichem, sowie die Erbringung von Catering-Leistungen und alle damit zusammenhängenden weiteren Leistungen und Lieferungen des Hotels (nachstehend gemeinsam auch „Leistungen des Hotels“ genannt).

2. Die Unter- oder Weitervermietung der überlassenen Räume oder Flächen bedarf der vorherigen schriftlichen Zustimmung des Hotels.

3. Für den Vertrag gelten ausschließlich die Geschäftsbedingungen des Hotels; Geschäftsbedingungen des Kunden werden nicht Vertragsinhalt, auch wenn ihnen nicht ausdrücklich widersprochen wird.

II. Vertragsschluss

1. Der Vertrag kommt durch die Annahme des Antrags des Kunden durch das Hotel zustande; diese sind die Vertragspartner.

2. Ist der Kunde/Besteller nicht der Veranstalter selbst bzw. wird vom Veranstalter ein gewerblicher Vermittler oder Organisator eingeschaltet, so haftet der Veranstalter zusammen mit dem Kunden gesamtschuldnerisch für alle Verpflichtungen aus dem Vertrag, sofern dem Hotel eine entsprechende Erklärung des Veranstalters vorliegt.

3. Das Hotel haftet mit der Sorgfalt eines ordentlichen Kaufmanns für seine Verpflichtungen aus dem Vertrag. Ansprüche des Kunden auf Schadensersatz sind ausgeschlossen. Hiervon ausgenommen sind Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Hotels beruhen und Schäden, die auf einer vorsätzlichen oder fahrlässigen Verletzung von vertragstypischen Pflichten des Hotels beruhen. Einer Pflichtverletzung des Hotels steht die eines gesetzlichen Vertreters oder Erfüllungsgehilfen gleich. Sollten Störungen oder Mängel an den Leistungen des Hotels auftreten, wird das Hotel bei Kenntnis oder auf unverzügliche Rüge des Kunden bemüht sein, für Abhilfe zu sorgen. Der Kunde ist verpflichtet, das ihm Zumutbare beizutragen, um die Störung zu beheben und einen möglichen Schaden gering zu halten. Im Übrigen ist der Kunde verpflichtet, das Hotel rechtzeitig auf die Möglichkeit der Entstehung eines außergewöhnlich hohen Schadens hinzuweisen.

III. Zahlungsbedingungen

1. Die vereinbarten Preise schließen die jeweilige gesetzliche Mehrwertsteuer ein. Sollte es in einzelnen Destinationen nach Vertragsabschluss zur Einführung einer Citytax oder anderen zusätzlichen Steuern, Steueranpassung oder Abgabe kommen, gilt automatisch der neue Mehrwertsteuersatz als vereinbart und der daraus resultierende Endpreis wird geschuldet.

2. Überschreitet der Zeitraum zwischen Vertragsschluss und Veranstaltung 4 Monate und erhöht sich der vom Hotel allgemein für derartige Leistungen berechnete Preis, so kann der vertraglich vereinbarte Preis angemessen, höchstens jedoch um 10 % erhöht werden. Das Hotel ist verpflichtet, dem Kunden eine Preiserhöhung rechtzeitig vor Durchführung der Veranstaltung mitzuteilen. In diesem Fall ist der Kunde berechtigt, binnen 10 Werktage vom Vertrag zurückzutreten.

3.Vorbehaltlich nachstehender Regelung in Ziff. 4 werden die Leistungen des Hotels nach der Durchführung der Veranstaltung in Rechnung gestellt. Rechnungen des Hotels ohne Fälligkeitsdatum sind binnen 10 Tage ab Zugang der Rechnung ohne Abzug zahlbar. Befindet sich der Kunde mit einer Zahlungsverpflichtung vollständig in Verzug, so werden alle noch ausstehenden Zahlungen sofort fällig. Bei Zahlungsverzug ist das Hotel berechtigt, Verzugszinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz zu berechnen. Bei Rechtsgeschäften, an denen ein Verbraucher nicht beteiligt ist, beträgt der Zinssatz 8 Prozentpunkte über dem Basiszinssatz. Dem Hotel bleibt der Nachweis eines höheren Schadens vorbehalten. Eine zusätzliche Mahngebühr fällt ab der 2. Mahnung an.

4. Das Hotel gewährt einem gewerblichen Vermittler oder Organisator eine Provision von maximal 10% der Nettopreise auf die vertraglich vereinbarten Leistungen. Ausgeschlossen sind der Frühstücksanteil im Übernachtungspreis, externe Leistungen, zusätzliche Gebühren, Stornierungen und Nichtanreisen (No Shows).

5. Das Hotel behält sich vor, eine Vorauskasse von 50% der gebuchten Leistungen zu verlangen. Der Restbetrag wird nach Veranstaltungsende mit Eingang der Veranstaltungsrechnung fällig.

6. Der Kunde kann Zahlungen nicht zurückhalten oder mit Gegenansprüchen aufrechnen, es sei denn, der Anspruch, auf den der Kunde sein Zurückbehaltungsrecht stützt oder mit dem er aufrechnet, ist unbestritten, rechtskräftig festgestellt oder entscheidungsreif. Die vorstehenden Einschränkungen gelten nicht, wenn der Kunde Verbraucher ist.

7. Der Kunde hat die Rechnungsanschrift auf Vollständigkeit zu prüfen und gegebenenfalls Besonderheiten (z.B. Rechnungstext, Bestell- oder Lieferantennummer, Kostenstelle, o.ä.) mitzuteilen, die zwischen uns zu einem reibungslosen Zahlungsablauf führen. Eine nachträgliche Änderung der Rechnung kann berechnet werden.

8. Für Veranstaltungen, die über 20:00 Uhr im Tagungsraum und über 22:00 Uhr im Speisebereich hinausgehen, berechnen wir einen Servicezuschlag in Höhe von €55,00 pro Mitarbeiter und Stunde.

9. Der Rechnungsversandt erfolgt standardmäßig per E-Mail. Eine Nachträgliche Änderung der Rechnungsanschrift wird berechnet.

IV. Rücktritt des Hotels

1. Wird die Vorauszahlung gemäß Ziff. 4 des Abschnitts „Zahlungsbedingungen“ auch nach Verstreichen einer vom Hotel gesetzten angemessenen Nachfrist nicht vom Kunden geleistet, so ist das Hotel zum Rücktritt vom Vertrag berechtigt. Die Geltendmachung von Schadensersatz bleibt ausdrücklich vorbehalten.

2. Sind Zahlungen vom Kunden an das Hotel, für bereits erfolgte Leistungen, auch nach Verstreichen einer vom Hotel gesetzten angemessen Nachfrist, nicht geleistet, so ist das Hotel berechtigt, sämtliche zukünftige Reservierungen zu stornieren und vom Vertrag zurückzutreten. Die Geltendmachung von Schadensersatz bleibt ausdrücklich vorbehalten.

3. Ferner ist das Hotel berechtigt, aus sachlich gerechtfertigtem Grund vom Vertrag zurückzutreten, falls höhere Gewalt oder andere vom Hotel nicht zu vertretende Umstände die Erfüllung des Vertrages unmöglich machen; in diesem Fall ist das Hotel verpflichtet, den Kunden unverzüglich über die Nichtverfügbarkeit der Leistung zu informieren und etwaige Gegenleistungen des Kunden unverzüglich zu erstatten. Leistungen des Hotels, die unter irreführender oder falscher Angabe wesentlicher Tatsachen, z.B. des Kunden oder des Zwecks, gebucht werden und der Kunde binnen einer angemessenen Frist die irreführenden oder falschen Angaben nicht korrigiert, hat das Hotel begründeten Anlass zu der Annahme, dass die Inanspruchnahme der Leistungen des Hotels den reibungslosen Geschäftsbetrieb, die Sicherheit oder das Ansehen des Hotels in der Öffentlichkeit gefährden kann, ohne dass dies dem Herrschafts- bzw. Organisationsbereich des Hotels zuzurechnen ist; ein Verstoß des Kunden gegen Ziff. 2 des Abschnitts „Geltungsbereich“ vorliegt und der Kunde trotz Abmahnung den Verstoß fortsetzt.

4. Die Ausübung des Rücktritts erfolgt in Textform und bedarf keinerlei Fristen.

5. Bei berechtigtem Rücktritt des Hotels entsteht kein Anspruch des Kunden auf Schadensersatz.

V. Stornierung des Kunden

1. Bei unberechtigtem Rücktritt des Kunden vom Vertrag (Stornierung) ist das Hotel unter Anrechnung etwaiger ersparter Aufwendungen berechtigt, unten aufgeführte Anteile der Gesamtauftragssumme zu verlangen. Dem Kunden bleibt der Nachweis, dass überhaupt kein oder ein wesentlich niedrigerer Schaden entstand, dem Hotel der Nachweis eines höheren Schadens vorbehalten. Der Rücktritt ist unberechtigt, wenn dem Kunden kein gesetzliches oder vertragliches Rücktrittsrecht zusteht.

VI. Änderungen der Teilnehmerzahl, Bestuhlungsformen und der Veranstaltungszeit

1. Eine Änderung der Teilnehmerzahl bedarf der Zustimmung des Hotels.

Bei einer Reduzierung ist folgendes zu beachten:

Reduzierung der Personenzahl bis 10% – 14 Werktage vor Beginn der Veranstaltung ohne Berechnung

Bei darüberhinausgehender Abweichung wird die vertraglich vereinbarte Personenzahl zugrunde gelegt. Im Fall einer Erhöhung der Teilnehmerzahl wird die tatsächliche Personenanzahl berechnet.

Bei einer Reduzierung der Personenanzahl behält sich das Hotel vor, die zur Verfügung gestellte Raumgröße entsprechend anzupassen.

Jede Änderung der Personenzahl muss dem Hotel in schriftlicher Form mitgeteilt werden und bedarf der Zustimmung des Hotels.

2. Verschieben sich ohne vorherige schriftliche Zustimmung des Hotels die vereinbarten Anfangs- oder Schlusszeiten der Veranstaltung, so kann das Hotel dem Kunden zusätzliche Kosten der Leistungsbereitschaft anteilig im Verhältnis der Dauer der Verschiebung zur Gesamtauftragssumme in Rechnung stellen, wenn die Verschiebung auf ein Verschulden des Kunden zurückzuführen ist.

3. Eine Änderung der geplanten Bestuhlung kann bis 18:00 Uhr, vier Werktage vor der Veranstaltung vorgenommen werden. Für den Fall, dass nach der vorstehend genannten Frist ein Umbau beauftragt wird, behält sich das Hotel vor, für die daraus entsprechend anfallenden Arbeiten mit €55,00 pro Mitarbeiter und Stunde in Rechnung zu stellen.

VII. Mitbringen von Speisen und Getränken

Der Kunde darf Speisen und Getränke zu Veranstaltungen nicht mitbringen. Bei Zuwiderhandlung wird das Hotel eine entsprechende Gebühr als Umsatzverlust erheben.

VIII. Technische Einrichtungen und Anschlüsse

1. Soweit das Hotel für den Kunden auf dessen Veranlassung technische und sonstige Einrichtungen von Dritten beschafft, handelt es im Namen, in Vollmacht und für Rechnung des Kunden. Der Kunde haftet für die pflegliche Behandlung und die ordnungsgemäße Rückgabe. Der Kunde stellt das Hotel von allen Ansprüchen Dritter im Zusammenhang mit der Überlassung dieser Einrichtungen frei, die auf einem Verschulden des Kunden beruhen.

2. Die Verwendung von eigenen elektrischen Anlagen des Kunden unter Nutzung des Stromnetzes des Hotels bedarf der vorherigen schriftlichen Zustimmung des Hotels. Durch die Verwendung der Geräte auftretende Störungen oder Beschädigungen an den technischen Anlagen des Hotels gehen zu Lasten des Kunden, es sei denn, er hat diese nicht zu vertreten.

3. Der Kunde ist mit vorheriger Zustimmung des Hotels berechtigt, eigene Telefon-, Telefax- und Datenübertragungseinrichtungen zu benutzen.

4. Störungen an vom Hotel zur Verfügung gestellten technischen oder sonstigen Einrichtungen werden nach Möglichkeit sofort beseitigt.

IX. Verlust oder Beschädigung mitgebrachter Sachen

1. Mitgebrachte Ausstellungs- oder sonstige Gegenstände befinden sich auf Gefahr des Kunden in den Veranstaltungsräumen. Die Haftung des Hotels für Verlust, Untergang oder Beschädigung richtet sich nach den Bestimmungen des Abschnitts „Haftung“.

2. Mitgebrachtes Dekorationsmaterial des Kunden hat den feuerpolizeilichen Anforderungen zu entsprechen. Auf Verlangen des Hotels hat der Kunde einen behördlichen Nachweis hierüber zu erbringen. Wegen möglicher Beschädigungen und der Einhaltung der Brandschutzverordnung, sind die Aufstellung und Anbringung von Gegenständen vorher mit dem Hotel abzustimmen.

3. Sämtliche mitgebrachte Gegenstände sind vom Kunden nach Ende der Veranstaltung unverzüglich zu entfernen. Kommt der Kunde dieser Pflicht nicht nach, ist das Hotel berechtigt, die Entfernung und/oder Lagerung der Gegenstände auf Kosten des Kunden vorzunehmen.

X. Haftung

1. Der Kunde haftet für alle Schäden an Gebäude oder Inventar, die durch den Kunden, seine Mitarbeiter, Erfüllungsgehilfen oder Veranstaltungsteilnehmer und -besucher verursacht werden.

2. Das Hotel kann vom Kunden die Stellung angemessener Sicherheiten (z.B. Versicherungen, Kautionen, Bürgschaften) verlangen.

3. Eine vertragliche oder außervertragliche Schadensersatzpflicht des Hotels besteht nur, sofern der Schaden auf grobe Fahrlässigkeit oder Vorsatz zurückzuführen ist. Für die schuldhafte Verletzung von Leib, Leben oder Gesundheit einer natürlichen Person haftet das Hotel auch bei nur einfacher Fahrlässigkeit. Darüber hinaus haftet das Hotel auch für die nur einfach fahrlässige Verletzung einer wesentlichen Vertragspflicht, allerdings der Summe nach begrenzt auf die Vermögensnachteile, die das Hotel bei Abschluss des Vertrages als mögliche Folge der Vertragsverletzung hätte voraussehen müssen. Für die schuldhafte Verletzung von Leib, Leben oder Gesundheit einer natürlichen Person haftet das Hotel unbeschränkt. Gleiches gilt für eventuelle Ansprüche nach dem Produkthaftungsgesetz. Die Beschränkungen der Haftung gelten auch für eine etwaige persönliche Haftung der Organe, Angestellten oder Erfüllungsgehilfen des Hotels. Der Kunde ist verpflichtet, das ihm Zumutbare beizutragen, um einen möglichen Schaden gering zu halten. Im Übrigen ist der Kunde verpflichtet, das Hotel rechtzeitig auf die Möglichkeit der Entstehung eines außergewöhnlich hohen Schadens hinzuweisen.

XI. Verjährung

Ansprüche mit Ausnahme von Schadensersatzansprüchen gegen das Hotel verjähren in einem Jahr ab Beginn der kenntnisabhängigen regelmäßigen Verjährung. Schadensersatzansprüche gegen das Hotel verjähren kenntnisunabhängig in fünf Jahren. Die vorstehenden Verjährungsverkürzungen gelten nicht bei Ansprüchen wegen der Verletzung des Lebens, des Körpers, der Gesundheit oder der Freiheit oder bei sonstigen Ansprüchen, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Hotels oder auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen.

XII. Schlussbestimmungen

1. Änderungen oder Ergänzungen des Vertrags oder dieser Geschäftsbedingungen müssen schriftlich erfolgen.

2. Soweit der Kunde nicht Verbraucher ist, ist Erfüllungs- und Zahlungsort der Sitz des Hotels.

3. Ausschließlicher Gerichtsstand ist der Sitz des Hotels, sofern der Kunde Kaufmann ist oder bei Vertragsschluss keinen Wohnsitz oder gewöhnlichen Aufenthalt in Deutschland hat, seinen Wohnsitz oder gewöhnlichen Aufenthalt nach Vertragsschluss ins Ausland verlegt hat oder sein Wohnsitz oder gewöhnlicher Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt ist. Das Hotel behält sich vor, den Kunden auch an seinem allgemeinen Gerichtsstand zu verklagen.

4. Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts sowie der kollisionsrechtlichen Vorschriften.

5. Haustiere sind nicht erlaubt.
